End-User Licence Agreement

Introduction and Acceptance

These Terms and Conditions (the "Agreement") are between you ("User", "you", "your") and BGC Dovercourt Club ("BGC Dovercourt", "we", "us", "our"). This Agreement governs your use of our online registration portal, including any related applications or services that connect to QuickBooks for payment processing (collectively, the "Application").

1. Purpose of the Application

The Application allows you to:

  • Register children for BGC Dovercourt programs (e.g., childcare, camps, after‑school activities);
  • Make secure payments using credit card or other payment methods;
  • Manage your account and view registration history.

The Application uses QuickBooks API services provided by Intuit to process payments. This integration is necessary for us to accept payments online.

2. License to Use

We grant you a limited, non‑exclusive, non‑transferable, revocable licence to use the Application solely for the purposes described in Section 1. You may not:

  • Copy, modify, or reverse engineer any part of the Application;
  • Use the Application for any unlawful or unauthorised purpose;
  • Share your login credentials with others or allow unauthorised access to your account.

3. QuickBooks API Integration and Your Authorization

The Application connects to QuickBooks using secure APIs provided by Intuit. By using the Application, you:

  • Authorise BGC Dovercourt to transmit your payment information (including credit card details and transaction amounts) to QuickBooks for processing;
  • Confirm that you have the legal authority to provide this authorisation (e.g., if you are a parent or guardian);
  • Acknowledge that QuickBooks and Intuit have their own terms and privacy policies, which you should review.

BGC Dovercourt is not responsible for:

  • Changes to QuickBooks APIs that affect the Application's functionality;
  • Interruptions or errors caused by QuickBooks or Intuit;
  • Payment processing mistakes that result from incorrect information you provide.

4. User Responsibilities

You agree to:

  • Provide accurate, complete, and current information when registering or making payments;
  • Keep your login credentials (username and password) confidential and secure;
  • Notify BGC Dovercourt immediately if you suspect any unauthorised access to your account;
  • Use the Application only for lawful purposes and in accordance with this Agreement;
  • Supervise any child or beneficiary whose information you manage through the Application.

5. Privacy and Confidentiality

We collect, use, and store your personal and payment information only as necessary to:

  • Process your registrations and payments;
  • Maintain records required by law (e.g., under the Child Care and Early Years Act, 2014);
  • Financial transactions, reports and analytics

All personal information is handled in accordance with our Privacy Policy and applicable Canadian privacy laws (including PIPEDA). BGC Dovercourt implements reasonable safeguards; however, no system is completely secure, and users are responsible for protecting their credentials.

6. Third‑Party Services

The Application relies on third‑party services, including QuickBooks. BGC Dovercourt is not liable for:

  • Failures, errors, or outages caused by third‑party services;
  • Changes to third‑party terms or APIs that affect the Application;
  • Data inaccuracies from external systems

7. Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE". To the fullest extent permitted by law, BGC Dovercourt disclaims all warranties, express or implied, including:

  • Merchantability or fitness for a particular purpose;
  • Uninterrupted or error‑free operation;
  • Accuracy of financial or registration data.

Users are responsible for verifying your own payment and registration details.

8. Limitation of Liability

To the fullest extent permitted by law, BGC Dovercourt shall not be liable for:

  • Indirect, incidental, special, or consequential damages
  • Data loss or corruption caused by your actions or third‑party services;
  • Payment processing errors resulting from incorrect information you provide.

9. Indemnification

Users agree to indemnify and hold harmless BGC Dovercourt, its directors, employees, and volunteers from any claims, losses, or expenses (including legal fees) arising from:

  • Your misuse of the Application;
  • Unauthorised access to your account caused by your failure to protect your login credentials;
  • Breach of this Agreement.

10. Termination and Account Closure

We may suspend or terminate your access to the Application if you violate this Agreement, create a security risk, or misuse the system. Upon termination, BGC Dovercourt will retain records as required by law, but you will no longer be able to register for programs or access your payment history through the Application with the terminated account.

11. Monitoring and Security

BGC Dovercourt reserves the right to monitor usage of the Application to ensure security, compliance with this Agreement, and proper operation. Any monitoring will be conducted in a manner consistent with our Privacy Policy and applicable laws of Canada.

12. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein. Any dispute arising under this Agreement shall be resolved exclusively in the courts of Toronto, Ontario.

13. Modifications

We may update this Agreement from time to time. If we make material changes, we will notify you by email or through the Application. Your continued use of the Application after changes are posted constitutes your acceptance of the revised terms.
